1999-30725-CICI: Memorial v News Journal

In the matter Memorial Hospital-West Volusia, Inc., v. News Journal, Tanner Andrews, and John and Jane Does 1..99, filed 31-Mar-1999, the Hospital Corporation sought a declaration that they were exempt from the requirements of §119.07, F.S., and §286.011, F.S.

The Court did not agree with them. Dismissing the Hospital's complaint, it proceeded on Andrews' and News Journals' respective counter claims.

2002-10126-CIDL: Andrews v MHS &al.

In #99-30725-CICI, the Court asked that those claims not depending upon the constitutionality of Ch. 98-330, L.F., be severed and filed as a separate action. By agreement of the parties, this was done.

The result is this litigation, covering only those acts and papers taken and prepared before the effective date of Ch. 98-330, L.F. (eff. 30-May-1998). The prayers for relief ask that essentially all acts by or for the Hospital Corporation, taken out of the Sunshine, be set aside.

2002-31972-CICI: Memorial v News Journal

In the matter Memorial Hospital-West Volusia, Inc., v. News Journal and Tanner Andrews, filed 04-Sep-2002, the Hospital Corporation sought a declaration that the judgement in #1999-30725-CICI does not apply to them.

2003-30495-CICI: Memorial v News Journal

In the matter Memorial Hospital-West Volusia, Inc., v. News Journal and Tanner Andrews, filed 11-Mar-2003, the Hospital Corporation sought a declaration that their violations of §286.011, F.S., and §119.07, F.S. should be considered cured, because they have been repeated.
